DROP‑IN PET SITTING SERVICE AGREEMENT & LIABILITY WAIVER

This Service Agreement & Liability Waiver (the “Agreement”) is entered into by and between Sharebear Pet Care, LLC, a California limited liability company (“SPC”), and the undersigned pet owner (“Client”) for drop‑in pet sitting services.
This Agreement is for ongoing or scheduled drop‑in pet sitting services. For ongoing or repeat clients, this Agreement remains in full force and effect until terminated by either party with written notice. Individual visit dates and schedules will be confirmed separately via booking confirmation or the Precise Petcare app. All terms apply to any and all services provided under this Agreement.
1. SERVICES & EXCLUSIVE ACCESS
1.1 Scope of Services. SPC agrees to perform the drop‑in visits (and overnight care, if booked) as detailed in the booking confirmation or on the Precise Petcare app. Services generally include feeding, fresh water, medication administration (if instructed), potty breaks/cleanup, play/exercise/enrichment, and a visual wellness check. SPC does not offer dog walking.
DROP‑IN & OVERNIGHT SERVICE STANDARDS

Drop‑In Visits: Up to 3 visits per day, available from 8:00 a.m. to 6:00 p.m.

Almost Overnight: Available from 7:30 p.m. to 9:00 p.m. with a surcharge.

Full Overnight Care: Available 7:00 p.m. – 7:00 a.m. Sitter may leave to perform other visits from 7:30 p.m. to 9:30 p.m. but will return by 10:00 p.m. at the latest.

Visit Times: All times are approximate. SPC uses a 2‑hour arrival window, except when precise medication timing is required.

Cat Care Minimum: Cats require at least 1 drop‑in per day, even when automatic feeders or litter boxes are present.
1.2 Exclusive Care Provider (No Job Sharing). SPC must be the sole person providing pet care in the home during scheduled visits. Job sharing—even with family members or neighbors—is strictly prohibited. Client agrees that no other person will enter the home for pet care purposes while SPC is engaged.
1.3 Unauthorized Persons on Premises. Client represents that no individual other than SPC’s authorized representative will be present in the home during any service. Should SPC arrive and discover an undisclosed person on the property, SPC reserves the right to immediately terminate services and vacate the home. Any such incident will constitute a material breach, allowing SPC to terminate this Agreement without refund, and SPC shall bear no liability for leaving the property under those circumstances.
1.4 Access & Keys.

Client must provide a working key at the Meet & Greet. If a key is not provided at that time, a $25 key pickup/drop off fee will be charged.

If SPC is unable to gain entry, Client will be notified, but the service time slot may be forfeited. It is the Client’s responsibility to make sure home is accessible.
2. CLIENT REPRESENTATIONS, DUTIES & HOME CONDITIONS
Client represents, warrants, and agrees as follows:

Pet Health & Behavior: Each pet is current on Rabies vaccinations, free from contagious illness, and has no history of unprovoked aggression. Client must disclose any bite history, behavioral quirks, or destructive tendencies. Pets must reliably respond to basic commands (sit, stay, come), be fully potty trained, and dogs must be contained by a secure, escape‑proof fence if outdoor access is permitted.

Veterinary Information: Client must leave a signed veterinary authorization card or letter on file that authorizes emergency treatment if Client cannot be reached. Alternatively, Client may complete SPC’s Veterinary Authorization Form.

Home Environment: Client will maintain a safe environment free of obvious hazards. Indoor temperature must not exceed 79°F during summer visits; working air conditioning and a constant supply of fresh water are required. SPC is not responsible for plant watering unless expressly agreed in writing; any plant care is provided as a courtesy and without guarantee.

If an SPC sitter is injured by Client’s pet or by a dangerous condition in the home, Client is responsible for all medical expenses incurred by or on behalf of the sitter.

Cameras & Monitoring: Client must disclose the presence, location, and recording capability of all indoor cameras or listening devices before services begin. No cameras or audio devices are permitted in bathrooms or areas where an SPC representative may reasonably expect privacy (e.g., a designated sleeping area). The discovery of an undisclosed recording device is grounds for immediate termination without refund.

No video or still photographs of SPC representatives may be taken or used for any purpose without SPC’s specific written permission.

Emergency Backup: Client must designate at least two local backup caregivers capable of assuming pet care in the event SPC is prevented from completing services due to emergency, force majeure, or termination. Client shall provide those contacts to SPC in writing and confirms that each designated backup caregiver has been notified and is aware that they have been listed as an emergency contact.

Pest & Parasite Control: The home and pets must be free of flea, tick, or other pest infestations. If SPC reasonably determines an infestation exists, SPC may suspend services and Client will remain liable for the full booking amount.
3. PAYMENTS, CANCELLATIONS & REFUNDS
3.1 Vacation Clients (For clients away from home overnight)

Booking 7+ Days in Advance: A 50% non‑refundable retainer is required at the time of invoicing to reserve your dates. The remaining balance is due the day before the first visit. No services will be rendered until the invoice is paid in full.

Booking Less Than 7 Days Before Service: A 100% non‑refundable retainer is due at the time of invoicing.
3.2 Day Care Clients (For clients not away from home overnight)

100% of the invoice total is due at the time of invoicing.
Payment Methods: SPC accepts payment only by debit or credit card through the approved booking software. Full payment is required before services begin. Services will not be rendered until the invoice is paid in full.
3.3 Holiday & Peak‑Period Bookings
For Holiday periods (including but not limited to Thanksgiving, Christmas Eve/Day, and New Year’s Eve/Day), SPC may require a higher non‑refundable retainer up to 100% of the estimated total. Holiday surcharges are additional and will be itemized on the invoice.
3.4 General Payment Rules

Clients will not receive a refund, credit, or pro‑rated discount for departing late or returning home earlier than scheduled.

Your spot on the schedule is guaranteed only after the retainer is paid.

Service dates are non‑transferable.

If cancellation is entirely at the fault of SPC, 100% of remaining services will be refunded.
4. CANCELLATION & REFUND POLICIES
4.1 Retainers

All retainers are non‑refundable under any circumstances.
4.2 Cancellation Deadlines
-
Vacation Clients (For clients away from home overnight): Cancellation must be submitted to Precise Petcare at least 7 days before the first scheduled visit to receive a refund of service fees minus the non‑refundable retainer. Late cancellations forfeit the entire service fee.

Day Care Clients (For clients not away from home overnight): Cancellation must be submitted to Precise Petcare at least 24 hours before the scheduled visit. Timely cancellations receive a credit only; no cash or card refund will be issued. Late cancellations forfeit 100% of the visit fee.

Peak Holiday Bookings: No refunds or credits will be issued for any cancellation once the booking is confirmed.

Cancellation by SPC. SPC reserves the right to cancel services for any reason. If SPC cancels before services commence, Client will receive a full refund of all amounts paid, including the retainer. (Except in cases of termination). If SPC withdraws after services have begun, Client will receive a pro‑rata refund of unused services, less any non‑refundable costs already incurred.
4.3 Refund Processing

Refunds (when applicable) will be processed to the original debit/credit card on file if possible. Client can also choose to receive refund as a credit.

Processing will begin within 3 business days.
5. LIABILITY WAIVER, ASSUMPTION OF RISK & INDEMNIFICATION
5.1 Acknowledgment of Risks. Client acknowledges that animals are inherently unpredictable and that even with the utmost care, accidents, injuries, property damage, escapes, illness, or death may occur. Client voluntarily assumes all such risks and releases SPC to the fullest extent permitted by law.
5.2 Waiver of Liability for Ordinary Negligence. SPC is not liable for claims or damages arising from ordinary negligence, including but not limited to:

Furniture, flooring, yard, or other property damage caused by pets or force majeure events.

Pet illness, injury, allergic reactions, medication complications, disappearance, escape, or accidental death.

Fines, citations, or legal violations resulting from pets with outdoor access or nuisance complaints.
-
Damage or loss resulting from power outages, equipment failure, extreme weather, or criminal acts of third parties.
-
Unsatisfactory plant watering results or other incidental household tasks.
5.3 Limitation of Liability. To the extent permitted by law, SPC’s total liability for any claim arising out of this Agreement shall not exceed the total fees actually paid by Client for the specific service period giving rise to the claim. SPC shall not be liable for any indirect, incidental, consequential, or punitive damages.
5.4 Indemnification. Client agrees to defend, indemnify, and hold harmless SPC, its members, employees, contractors, and agents from any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to:

Any act or omission by Client that breaches this Agreement.

The actions of Client’s pet(s), including bites, property destruction, or injury to third parties.

The condition of Client’s property, including hidden defects or hazards.
-
Any veterinary or medical treatment authorized under this Agreement.
6. EMERGENCY VETERINARY CARE & MEDICAL AUTHORIZATION
Client authorizes SPC to act as agent for the pet(s) in seeking emergency veterinary care whenever SPC, in its sole discretion, deems it necessary. In a life‑threatening situation, SPC may transport the pet to the nearest available veterinarian. Client accepts full financial responsibility for all costs, including but not limited to veterinary bills, emergency transport, drive time (at SPC’s hourly rate), and the sitter’s time spent at the hospital. Client agrees to maintain a valid veterinary authorization card on file and to notify the veterinarian of this Agreement.
7. PROFESSIONAL CONDUCT & TERMINATION FOR CAUSE
7.1 Mutual Respect. SPC is committed to a professional, respectful working relationship. Client, as well as any person on the property, agrees to treat SPC representatives with courtesy and to refrain from verbal abuse, threats, harassment, intimidation, physical aggression, or any conduct that endangers safety or well‑being.
7.2 SPC’s Right to Terminate. If SPC reasonably determines that the conduct described in Section 6.1 has occurred, or that the home environment has become unsafe or materially different from what was disclosed, SPC may immediately suspend or terminate services. In such cases, any refund (if any) will be determined at SPC’s sole discretion, taking into account services already performed, costs incurred, and the nature of the breach.
8. INSURANCE & THIRD‑PARTY COVERAGE
SPC carries commercial liability insurance applicable to its pet sitting operations, subject to its policy terms. However, Client is strongly encouraged to maintain homeowner’s or renter’s insurance that covers pet‑related incidents and property damage.
9. FORCE MAJEURE
SPC shall not be liable for failure to perform any obligation under this Agreement when such failure is due to causes beyond its reasonable control, including but not limited to natural disasters, fire, flood, earthquake, severe weather, pandemics, government orders, transportation disruptions, or personal emergency of the assigned sitter. In a force majeure event, SPC will make reasonable efforts to notify Client and, if possible, arrange alternative care using Client’s backup caregivers. No refund will be owed for visits that cannot be completed due to force majeure, but SPC will apply a credit for future services at its discretion.
10. MEDIA RELEASE
Client grants SPC license to use photographs and videos of the pet(s) for advertising and social media purposes. Media containing Client’s personally identifying information will not be used.
11. GOVERNING LAW & DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to this Agreement shall first be submitted to mediation in Stanislaus County, California. Client knowingly and voluntarily waives any right to a jury trial or to participate in a class action.
12. MISCELLANEOUS
12.1 Entire Agreement. This Agreement, together with the Policies and Procedures and any signed addenda, constitutes the entire understanding between the parties and supersedes all prior oral or written representations. No modification shall be effective unless in writing and signed by both parties.
12.2 Severability. If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12.3 Waiver. SPC’s failure to enforce any term shall not constitute a waiver of future enforcement.
12.4 Successors & Assigns. This Agreement binds and benefits the parties and their respective heirs, executors, administrators, and assigns. Client may not assign this Agreement without SPC’s written consent.
13. CLIENT ACKNOWLEDGMENTS & SIGNATURE
By signing below, Client certifies that they have read, understand, and agree to every provision of this Agreement. Client has had the opportunity to ask questions and obtain independent legal advice.
